For Kanha Herbs Pvt. Ltd. (“Company”), strict compliance with the rules and regulations notified by the authorities on direct selling is a top priority.
The Company is fully committed to taking all possible steps to protect consumer interests and ensure that their rights are safeguarded at all times.
Kanha Herbs requires all Direct Sellers to follow ethical business practices, and ensures that no unfair trade practices are carried out that could harm, mislead, or negatively affect consumers.
Applicability
This policy applies to all Direct Sellers of Kanha Herbs Pvt. Ltd. If a Direct Seller fails to comply with the conditions, rules, or responsibilities outlined by the Company, it may result in their de-listing (termination) from the Company’s network.
Objective
The purpose of this policy is to ensure that Direct Sellers follow fair and ethical practices at all times. A Direct Seller may be de-listed if they fail to meet the standards, responsibilities, or requirements of the Company or its consumers.
The main objective of the De-Listing Policy is to:
- Promote fair trade practices
- Protect the interests of consumers
- Ensure that Direct Sellers operate with integrity and accountability in the long run
Applicable Laws
This policy is prepared in compliance with the following laws:
- Consumer Protection (Direct Selling) Rules, 2021
- Consumer Protection Act, 2019
- Consumer Protection (E-Commerce) Rules, 2020
Who is a De-Listed Direct Seller?
A De-Listed Direct Seller refers to a Direct Seller whose authorization has been suspended or cancelled by Kanha Herbs Pvt. Ltd. due to non-compliance with Company rules, Code of Conduct, or applicable laws.
Grounds for De-Listing a Direct Seller
A Direct Seller may be de-listed on the following grounds:
- Violation of Code of Conduct of Kanha Herbs.
- Fraudulent Activities – Engaging in fraud, misrepresentation, false claims, coercion, harassment, or unlawful practices.
- Misleading Conduct – Making false or misleading statements about the Company, its products, or services.
- Mis-Selling or Bulk Selling of products/services in a way that harms consumers.
- Unethical Practices – Using fraudulent, coercive, or unlawful means for sales or promotions.
- Failure in Returns/Refunds – Refusing to take back defective/spurious goods or denying refunds for deficient services.
- Illegal Charges – Demanding entry fees, subscription fees, or any unauthorized charges from consumers.
- Inducing Purchases with False Promises – Convincing consumers to buy by claiming they can recover costs by referring new customers.
- Disqualification by Law – If convicted, declared bankrupt within the last five years, or declared of unsound mind.
- Failure to Deliver Products within the prescribed time or engaging in the following
prohibited practices:
- Promoting or participating in a Pyramid Scheme.
- Engaging in a Money Circulation Scheme.
- Involvement in unfair trade practices under the Consumer Protection Act, 2019.
- Being inactive with the Company for more than two years.
- Holding a direct selling code with another direct selling entity (directly or indirectly, including through dummy persons).
- Defaming the Company’s goodwill or reputation before consumers, other direct sellers, or the public.
- Instigating other Direct Sellers against the Company.
- Non-Compliance in Operations, including:
- Visiting consumers without an identity card or prior appointment/approval.
- Using unapproved literature or promotional materials.
- Making unauthorized product claims beyond what is approved by Kanha Herbs.
- Selling products through unauthorized E-commerce platforms (such as Amazon, Flipkart, Snapdeal, etc.).
- Failing to complete mandatory registration under the Direct Selling Rules, 2021.
- Any other grounds as may be decided by Kanha Herbs from time to time.
Impact of Delisting
- A De-Listed Direct Seller will be barred from selling or purchasing any products of Kanha Herbs Pvt. Ltd.
- Their name will be removed from the official register of Direct Sellers maintained by the Company.
- The individual’s name will instead be recorded in the Register of De-Listed Direct Sellers.
- The name of the De-Listed Direct Seller will also be displayed separately under the “De-Listed Direct Sellers” section on the Company’s official website: www.kanhaherbs.in
Process of De-Listing a Direct Seller
- If a Direct Seller commits a breach of duty or policy violation, the Company will issue a Show Cause Notice to the concerned Direct Seller.
- After receiving the notice, the concerned Direct Seller must appear before the Company within the specified time frame and provide valid reasons or explanations in response to the notice.
- After giving the Direct Seller an opportunity to be heard, the Company will evaluate the
explanation:
- If the Company finds the reason genuine and supported with valid evidence, the Direct Seller may be allowed to continue, at the sole discretion of the Company.
- If the explanation is not satisfactory, the Company has full authority to cancel or suspend the Direct Seller’s name from the official register.
- If the concerned Direct Seller fails to appear within the given time frame or does not provide any response/evidence, the Company may proceed with cancellation/suspension of their authorization.
- Once de-listed, the Direct Seller’s name will be:
- Removed from the Register of Direct Sellers
- Entered into the Register of De-Listed Direct Sellers
- The name of the de-listed Direct Seller will also be published on the Company’s official website (www.kanhaherbs.in) under the section titled “De-Listed Direct Sellers.”
- The Company will take appropriate action based on the nature of the offence committed by the Direct Seller. Kanha Herbs also reserves the right to take any legal action if required under applicable laws.
Notification of Changes
Kanha Herbs Pvt. Ltd. keeps this De-Listing Policy under regular review to ensure it remains accurate and up to date.
Any changes made to this policy in the future will be published on this page.
